I'm pretty sure it has to be on so you can run Software - which is why you'll need a computer

If you have a regular phone line, you can just have your MagicJack calls forwarded to your regular phone.

i guess but what would the point of that be? :P

I said "If you have a regular phone line". There are many good reasons for having a regular phone line, but your question is apparently rhetorical, so I will just leave it at that.

MagicJack vs. Vonage vs. Skype
MagicJack:
The catch is: to make or receive calls with MagicJack your computer must be turned on with the MagicJack software running.

I have been using MagicJack for about a year and a half, and I have all incoming calls forwarded to my regular phone. I do not have to have my computer on to receive calls; only to make them.
MagicJack FAQ
Q. Does my computer need to be on to make or receive calls?
A. Yes, it does. You also need a working internet connection. Your computer does not need to be on for users to send you voicemail or for call forwarding
tradertalk:
If you do not have a regular phone line, then this suggestion does not apply.
