At the same time they awarded open ended contracts to large companies like Haliburton to rebuild the devastated regions. A virtual bonanza for the rich & a kick in the teeth for the working class.
    They really are out to get you. Well maybe not you, but all of us aren't rich & most of us have to work for a living.

    The state govenor has control over the state militia, ie, national guard. if/when a disaster occurs, it is within the govenors power to call up/utilize those troops to his/her best ability. SHOULD a disaster/occurance be expected to overwhelm the capability of state/local government, the govenor can REQUEST assistance from the feds. That request can be done verbally, but legally needs to be a written request. the govenor(s) of the affected areas of katrina/rita requested federal assistance to include federal troops. bushy can't impose federal assistance without requests, which occured in the circumstances of said recent disasters. fed troops were not dispatched to 9/11, as they were not requested.

    I doubt the if the states asked for federal police action towards their citizens. This is where they have violated the law. Perfectly good for them to provide assistance but the policeing should be left to the state and local authorities.

    Seems to me that in circumstances like this, the Posse Comitatus Act is pwned by Department of Homeland Securities' National Response Plan in accordance with Robert T. Stafford Disaster Relief and Emergency Assistance Act .
    Amusingly, they point more porkbelly fingers at bushy and his posse de thanku appointees as the shoulders of burden in said debacle.

    in short, what those linkies state is, in an emergency, when requested by the state, once the president designates an area a disaster zone, the responsibility and command and control in all circumstances falls squarely on the federal government. LOGICALLY, the government utilizes the local assets, but has power to supercede at any given point. Once designated an emergency, bushy could've claimed federal martial law and legally would've been in the right.

    Normal military doesn't have these powers though, just the NG.

    Of course, most of the NG are in Iraq, making up 50% of the US troops there to 'protect democracy' with their guns by killing people whos country they helped to invade...

    No, you need to get your facts straight. The National Guard is comprised of state militias. They are not under the control of the federal government unless the regular army is exhausted and only then can they be called up for a foreign war. Why start a war if you don't even have the regular troops to fight it? This is a power play and a catch 22. If the National Guard was ready for duty Bush wouldn't need the rule change to use regular army for policing civilians.

    Technically, the fed needs to respond to states requests for backup for an incedent, unless it's an incent national of war

    It's not a question of what is possible. An infinite number of bad things as well as good things are possible. The constitution was set up in such a way that each branch of government is checked by the others, but it can be overthrown by a few bad men, in which case it is still a bad thing no matter your opinion.
