Supreme Court refused to hear [i.e. denied certiori] to Microsoft's appeal of finding of monopolistic practices in violation of law. By denying certiori aka denial of even hearing the appeal, the High Court did not have to give reason or reasoning.

Hence, remedies for MS monopolistic practices in restraint of trade [monopoly per se is not illegal] will be determined in lower Courts.

Sorry again about the dead link--did my best. Maybe too much traffic now--dont know.

In my opinion, continuing to seek judicial remedies against MS for restraint of trade AND hence upholding the finding of monopolistic practices IS a victory for free enterprise.

And how does that help free trade?

All it does is to prove that there are people in high courts that will refuse to make decisions on constitutionally garenteed freedoms.

We all know MS was persecuted by the clinton administration in the first place.

The Supreme Court is flooded with cases and appeals. It selects those it feels have merit in raising an Constitutional issue.

By denying certiori, it indicated it did not feel MS had adequately demonstrated a Constitutional issue.
