Mntsnow 09-16-2000, 11:19 PM Scotter has given you some good advise. Get the authorities involved immediately if threats have occured. RobRich 09-16-2000, 11:23 PM Go the legal route, and get the authorities involved. A great place to start is obtaining the phone records (as Scotter sugested). Definitely call the police immediately! Since you believe this to be an international incident, also have her contact the local FBI office. Don't attempt the illegal way of hacking, as this could land you in trouble as well. Better to play it legit, that way only the scumbag on the other end gets "nailed." Good Luck, Robert Richmond [This message has been edited by RobRich (edited 09-16-2000).] brandon184 09-16-2000, 11:45 PM Definately have her contact the local authorities. They will have their ways of tracking the guy down. RobRich.. I don't think the FBI has any power in other countries than the US. If so - how so? RobRich 09-17-2000, 12:42 AM The FBI doesn't have any direct authority in any country outside of the US, but they do have the authority to negotiate with foreign police authorities for the possible arrest of the individual sending the threats. The person recieving the threats is within the US. Most local police authorities in the US can do little about Internet related criminal issues, especially anything regarding international communications. The FBI is normally quite helpful when dealing with Internet related crimes. Hope this explains my comments, Robert Richmond [This message has been edited by RobRich (edited 09-17-2000).] thekingofpain 09-17-2000, 01:14 AM Whats the chance of some dum bass coming to the states to follow up like that? Do ya really think he would throw his life away in a foreign country for someone he met online?? shadow 09-17-2000, 10:30 AM Same as above [This message has been edited by shadow (edited 09-18-2000).] socalgal 09-17-2000, 11:09 AM Check it out: List of Women Halting Online Abuse - Cyberstalking Laws (http://www.haltabuse.org/laws.html) For example, California: "Cal. Civil Code § 1708.7 (a) A person is liable for the tort of stalking when the plaintiff proves all of the following elements of the tort: (2) "Credible threat" means a verbal or written threat, including that communicated by means of an electronic communication device, or a threat implied by a pattern of conduct or a combination of verbal, written, or electronically communicated statements and conduct, made with the intent and apparent ability to carry out the threat so as to cause the person who is the target of the threat to reasonably fear for his or her safety or the safety of his or her immediate family. (3) "Electronic communication device" includes, but is not limited to, telephones, cellular telephones, computers, video recorders, fax machines, or pagers. "Electronic communication" has the same meaning as the term defined in Subsection 12 of Section 2510 of Title 18 of the United States Code." Note the UK laws at the bottom of the above page. Not sure how old this is: Cyberstalking - Is it Covered by Current Anti-Stalking Laws? (http://gsulaw.gsu.edu/lawand/papers/su98/cyberstalking/) Also, depending on what state she's in, try getting some info from here: State Stalking Laws (http://www.ncvc.org/law/statestk.htm) For example, California: "Penal Code section 646.9. Stalking. 1998. (a) Any person who willfully, maliciously, and repeatedly follows or harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety, or the safety of his or her immediate family, is guilty of the crime of stalking, punishable by imprisonment in a county jail for not more than one year or by a fine of not more than one thousand dollars ($1,000), or by both that fine and imprisonment, or by imprisonment in the state prison." Maybe contact an Internet specialist or criminal attorney or paralegal, or legal aid society. Best wishes to your friend and you in dealing with this creep. dang HTML tags http://sysopt.earthweb.com/forum/frown.gif [This message has been edited by socalgal (edited 09-17-2000).] Mulely 09-17-2000, 02:22 PM Shadow Your friend that is being stalked on the net should go to this site, www.cyberangels.org (http://www.cyberangels.org) This site has chat rooms and all your friend has to do is type in "Help I'm Being Stalked" There are people there that work with law enforcement agencies from around the world all working to track down cyber stalkers. If an individual is being stalked or threatened on the net it should be taken very seriuosly. mulely Emperor_Nero 09-17-2000, 05:56 PM "Whats the chance of some dum bass coming to the states to follow up like that? Do ya really think he would throw his life away in a foreign country for someone he met online?" well, considering that the staulker is actually wasting a lot of long distance money for the phone calls, no one can really safely say he won't come. "She has called police and they tell her they cant do a thing unless he shows up there. The phone co. cant trace his calls, he uses a mobile. This man has told her he has a flight booked early Oct. and she has confirmed that." even if it's mobile, the phone company should have been able to trace his calls...unless he has some caller id block. just tell her to note down the exact time and day he called and tell the company those times - if the phone company cannot trace the calls, then something is definitely wrong. to be honest, the way you said the phone company can't trace a call, it seems very suspicious because they do use sophisticated equipments and keeps a detailed log; and according to the way you're so eager to get some personal info on the guy despite knowing it can be illegal, it seems like you're making everything up to find ways to hack into your friend's acct. just voicing my observations. Entragian ][ 09-17-2000, 06:46 PM Incase your friend hasn't done this already. Hide your IP in ICQ and do not put information in that you do not want anyone to know. <ie> real name, birthdate, phone #, etc. shadow 09-17-2000, 10:50 PM and again [This message has been edited by shadow (edited 09-18-2000).] beardog23 09-18-2000, 12:10 AM Man, sounds like she is in a crazy situation... like everyone else has been saying, its best to get the authorities. bdog 09-18-2000, 12:19 AM I don't want to start a gun debate here, but has she considered any means of self defense? If not a gun then at least some pepper spray or something. By all means get the authorities involved, but be prepared just in case the bad guy shows up when the cops are not there. barry glisson 09-18-2000, 03:12 AM the technology to triangulate cell phones is available today. I think it takes a court order though. With a tap on the victims phone the cell phone unique id number, which is used for billing, is revealed. The fbi has taped drug dealers conversations as they traveled up I95 from Miami to NJ. MASTOURA 09-18-2000, 03:40 AM Also, I would reccommend the legal way. However, there are some other things she can also do, like: 1) "Kill" her ICQ account and create a new one. 2) Contact ISP and request that her IP is changed (that is if she has a cable connection). This way the "stalker" can no longer find her (at least easily). I hope that your friend will be fine. ICQ is a great tool for communication, but it is common sense that importnat personal data like home address must not be disclosed. MASTOURA deltaf508 09-18-2000, 05:26 AM If you want my opinion, have her stay with a friend for a while. If she has confirmed his plans, that means he is serious. Don't mess around with a$$holes like that. Get proof of his intentions on paper (flight plans, screenshots, recorded telephone calls, whatever it takes) then take them to the authorities in a file folder. Tell them you are not looney, but that you are scared as hell. If they still won't help her. then we have some dumba$$ Authority figures in this country. KAknight 09-18-2000, 07:03 AM There is still enough time to purchase a handgun. I think your friend would be wise to get one. Brian48 09-18-2000, 07:20 AM Personally, if some nitwit like that made a threat against me, I'd welcome the opportunity to plug a few .45 caliber holes in his @ss. Come on over, pal, Fingers 09-18-2000, 08:50 AM Gun or no gun, I wouldn't want someone stalking me. While a gun can offer some protection, and I certainly suggest that someone who is in fear for their safety have one, it won't keep you safe in all situations. This is a matter for law-enforcement, not vigilantes. I am somewhat concerned that you feel the need to track this guy down. Are you sure that your being candid with us about your motives? How was your friend able to "confirm" that the stalker has purchased an airplane ticket? Exactly what do you expect to achieve by identifying this guy. If the authorities won't get involved based on his ICQ # and Yahoo ID, obtaining his name won't help either. alondra 09-18-2000, 11:05 AM I too am puzzled by the "comfirmed ticket" to know this, is to know the airline, flight number, time and date, and name, either real or assumed. but the name that will be used on the flight. Hmmmm. shadow 09-18-2000, 11:13 AM No more for me [This message has been edited by shadow (edited 09-18-2000).] alondra 09-18-2000, 01:04 PM would seem to me that with this much info the cops should be willing to go with her to the airport and meet this flight and the guy. and presuade him to get on a return flight, or a friend who is an 800 # gorilla could be pursuasive. with all this info seem strange the cops will take no action. remember also that all you know about this "friend" is over ICQ [This message has been edited by alondra (edited 09-18-2000).] SysOpt.com
