internet connection speed

I've got a 56k modem which says it connects to the internet at 53k or 54k usually. But when I download something it only goes at 4k or 5k per second, why is this? Shouldn't it download at 53k per second like it says? Also someone once told me the phone lines in my city can only support speeds up to 33k no matter what, is that possible?
