Is it legal to buy someone else's copy of windows? Say they use winxp now and want to sell thier win98cd

I think if its the original disk and key you would be ok.

Unless they used an update cd to put XP on their PC. That would make the win98 cd no longer usable according to the eula.

I have worked with microsoft on getting a business legal with all of its software. If you use an upgrade cd you must keep the original disk(s). If you use a retail or oem cd and it is legal you can sell the old cd. To make it legal you need the original disk(s) and Certificate of autehticity and CD Key. Some older MS programs had the CD Key on the case and not on the Certificate. MS even replaced our missing software titles. We had 10 COA's and only 6 copies of office and the sent use 4 more copies of office for shipping and handling. With the OS we only had one copy of 95 and 98 with COA's and had to purcahse a full version for each PC that had the CD and COA missing.

My original win98cd was cracked and the receipt destroyed in a flood we had a while back and I had never registered it. Luckily I had made a backup ( I geuss this is also legal), I've had several reformats and installs since then due to hardware changes and I don't have complete confidence in the quality of my backup cd. I can't afford xp right now so I want to be able to assure someone that they won't get into trouble for selling me their no longer needed original ( for cheap I hope!). Thanks for all the great advice. Always great help on SysOpt.
