From the beginning
My brother and I were using AT&T GSM $99 per month unlimited calling and Nextel. When we called Nextel to cancel the service they asked us why?
We told them that were switching to the GSM service totally and did not need the extra cost. Nextel told us they we will match AT&T's GSM $99 per month and give us unlimited text messaging. So we thought great Nextel is really good service will keep Nextel and tell AT&T good bye. And we did just that lost $299 per phone $200 cancellation fee for a total of $1000 cost to us for canceling AT&T.
Then on January 14th my brother gets a letter from Nextel telling him that his plan will be going to $149 per month. So he called me and we both called Nextel
and the guy we spoke with was rude, arrogant and a total *****. So we still have or AT&T phones and we told Nextel **** on you will cancel, they told us there would be a $200 cancellation fee! Of course we said what the hell you talking about they said you have a two-year contract. So we asked them if we have a two-year contract how can you just change the price at any time. The rude ***** said read page three blah blah paragraph blah blah line blah blah and don't sign things you don't understand.
Then we informed the ***** we never signed anything we changed our contracts over the phone. His his reply was pay $200 to cancel don't pay your bill will Shut your phones off it's not my problem.

You know, this is the scurge of the earth. I hate people that don't read small print, don't know what they are doing and then go "OOh, it's not my fault, I'm going to sue you". It pushes insurance premiums up, p*sses me off and more importantly gets everyone rattled.
I was once sued, a long time ago I broke someone's leg (a very unfortunate and nasty accident), 6 years later they came back with a lawsuit!!! It's these sodding adverts "To our customers we are second aid", "no fee", what are we, Human who try to tolerate each other or bottom feeding loaches trying to earn as much money from doing NOTHING. Learn people, that if it is your fault, you didn't look where you were going, you didn't read the small print and more importantly it isn't mine so why the hell should I pay for you to get a little bit of money???
Having said that, I support legit claims for medical bills and what not, just not "compensation". The best one I've ever heard was a group of Americans (surprisingly - this whole thing seems to stem from them) sueing McDonalds because they ate the food and got fat :mad: :confused: :mad:
Ooh, I hate people who does this. They are the scurge of the earth. This sort of practice should be outlawed.

NEVER SAW THE CONTRACT IN CA VERBAL IS BINDING ......DID IT OVER THE PHONE
Was calling to kick Nextel and they said "wait wait we can beat AT&T" lying pc's of SH@#
Don't know about your business ...but in mine if mid stream I said BTW my fee will be 10% at the close escrow instead of the 6% we agreeded on..........and if you cancel your listing with me it will cost you .......................BS BS I would be in court forever!!!:mad: :mad:

Have you called and spoke to a supervisior? Be sure to inform them how rude the person you spoke to was.
Nextel is no worse than any other cell phone service provider.

If in fact they want to go by the verbal agreement via telephone is binding, than they need to render to you terms of such and agreement stating that anytime during the contract that have reserved the rights to raise rates above an beyond what was agreed to when you intially entered into said contract. Here in New York state we have a 15 day buyers remorse grace period which allows us to back out of any contracts with such communication services without being moneterialy penalized. During such period the contract in writing must be delivered to the cutomer in writing.
Cell phone companies as such are not utilities and can therefore raise their rates as they wish, but must inform you of any such change in charges as to allow you to decide wether or not you are going to continue with their service because when they change rates they also are changing the terms of said contract. Legally they are locked to the price that was agreed upon when entering said contract unless within said contract is a rider stating otherwise. But you still have the option of terminating the contract without penalties in such an event because a 50% increase in rate would be considered usuary.
So I bet somewhere in that contract it stated that the $99 was for a certain time period only. And that after that it would resume at normal rates.

According to the man on the phone.... when I wanted to cancel the $99 a month would be as long as I had the phone.
The $99 a month plan never existed they were just matching AT&T so that we would not cancel.
UP-DATE
After calling about 200 times between me and my brother and calling and e-mailing all the news channels where I live.
My brother scheduling an appointment to go on afternoon radio talk show.
Nextel has now told us they will not charge the $200 cancellation fee and they will allow us to keep our current plan for 12 more months. Not that this is good:mad: ....But it will allow us enough time to change the numbers on our ads and magazines.

Thats why every time I speak to a rep I get names, #,s, office they work in, etc, because **** like that happens way to often in the sales world. If the person told you $99 for as long as you kept that plan, and then switched to $149 it's out and out fraud and I would be contacting the FTC with names and #'s and see how quickly the theiving little miscreants call me back with an apology and some freebies. Start a website for people frauded by that company and see how many responses you get then file a class action lawsuit.
also nextel comm. has an unsatifactory record with the BBB concerning their sacremento office and won't answer complaints against themselves.

Whoa ! . When you read about the horror stories customers of nextel have had it's just plain screwed. It's sooo obvious that this company is destined to go out of business and dissapear into a black hole along with all of the money it's fraudulently harvested from it's customer base. I mean can you imagine thinking you have the safety of having the nextel bill on auto pay from your bank account so you think it's one less problem to deal with each month only to discover nextel cleaned out your bank account. I mean they actually have to check and see how much money is in your account so they know how much to transfer out for the auto pay. Thats not a mistake, thats deliberate and premeditated.
It also seems they ask all of their customers for deposits, which if your credit rating is good there should be no need for a deposit. And then they never return the deposit and even told some customers that they didnt have a deposit with them even after the customer produced credit card bills and receipts stating so.
I can look at their history, and the endless customer complaints that are out there on the web and tell you that they are going to be just like another enron, leaving everybody screwed and ripped off.
