I sold some stereo equip on ebay to some guy, he pays me via paypal.
Now I get an email from paypal that he was using a stolen credit card and they have tooken it from my account which is now in the negatives.
I think this is unfair considering I already shipped out the stuff.
Anyone else go through this before?
-izzy
didn't you have any email correspondences with the guy? You actually sent it to a house address right? You can track him down if you really try to go after him. I would at least look into it...

Izzy, if PayPal won't help you, try one of these agencies.

Get the authorities involved! Sorry to hear this, izzy.

Yeah I don't think paypal can legally do that?? Aren't they supposed to check the credit cards that the person is using? Also, if they just created an account using that person's information, paypal can still find out their IP address most likely. That will at least narrow it down just a tad...

That's too bad man http://sysopt.earthweb.com/forum/frown.gif Where did you ship the stuff to? Maybe someone here is nearby! If he's in Missouri, let me know, I'll stomp a mud-hole out of someone's backside for being a $h!thead http://sysopt.earthweb.com/forum/wink.gif

Izzy, raise hell with Ebay also! Here's a few links:
Safe Harbor/Investigations: http://pages.ebay.com/help/community/investigates.html
Dispute Resolutions: http://pages.ebay.com/services/buyandsell/disputeres.html
All links from Safe Harbor: http://pages.ebay.com/help/community/index.html
Ebay has some responsibility in this matter, they're suppose to verify name/address/credit card info, etc!
Mosinee, WI is near Wausau, Marshfield, Green Bay maybe one of the members is near that area and could maybe pay him a little visit?
What is the POS's user name on Ebay? E-mail me all info you have on him! I've got an old friend that lives about 150 miles North of there. I haven't seen him in a few years, but for a case of beer, he used to do about ANYTHING http://sysopt.earthweb.com/forum/wink.gif If I can verify that he's there and that's his name, I'd gladly make a call http://sysopt.earthweb.com/forum/smile.gif One thing I can't stand is internet-ripoff-$h!theads!!!!!!!!!!!

I think thats why some shippers nowadays will only ship to the billing address associated with the card, so the cardthief has to result to purchases like this, unfortunately I dont think Paypal has a way of monitoring that...

I got an email from paypal here it is...
Thank you for your replies and the abundance of information.
Your PayPal account currently has a negative balance pending my
investigation. As was explained in the previous email, the credit card
that
was used to fund the transaction with Kevin Cybula has been reported to
have fraudulent activity. This transaction was the fraudulent activity.
Per PayPal's Terms of Use, Section 1, paragraph 8:
Receipt of Payments; Risk of Reversal of Transactions; Collection of
Funds
you owe PayPal. When you receive a payment through the Service, unless
you
follow the steps necessary to qualify for our Seller Protection Policy
described in Part IV of this User Agreement, you are not protected
against
a subsequent reversal of the transaction. In the event that the
senders
transaction is reversed for any reason and you do not qualify for the
Seller Protection Policy for that transaction, you will owe PayPal for
the
amount of the reversed transaction plus any fees imposed on PayPal as a
result of the reversal. Examples of such a reversal include, but are
not
limited to, a credit card charge-back by the sender of the payment, and
a
reversal of the transaction because the sender of the payment was using
a
stolen credit card or unauthorized checking account. PayPal will seek
to
recover the funds from you by debiting your PayPal balance and, if
there
are not sufficient funds in your PayPal balance, PayPal reserves the
right
to collect your debt to PayPal by any other legal means. You authorize
PayPal to charge your credit card or debit card in the amount of any
debt
to PayPal. You authorize PayPal to obtain a credit report on you in the
event that you incur a debt to PayPal.
Mr. Esquivel, do you have the priority shipping information, i.e.,
tracking
number, receipt, etc.?
If you have any further comments, questions, or concerns, please do not
hesitate to contact me again.
Sincerely,
Bryant

Spuck, I've been buying and selling on Ebay for several years...only one bad transaction there! BUT!! on Boxlot, I got took for $875. The SOB that got me, also got several hundred others, we fought, wrote, and made phone calls. Ol Wesko finally made the Top 10 Internet Fraud list...is on the run...and under federal charges! Rumor has it, he may be in Ohio! I found this out yesterday. If I can get a approximate location...ROAD TRIP http://sysopt.earthweb.com/forum/smile.gif

If you find out where in Ohio, post it, maybe I can help if it's in the southwestern portion of the state.
Izzy...have you called this number that Randy48 has provided?
I called, but got the answering machine...it was a recording of a female voice.
The address you have provided is legit and goes under the name:
Debra Cybula
1213 Norway Dr
Mosinee, WI 54455
It is a listed and legit residency, with an un-listed telephone. So we can't link the number to the address quite yet. The 715 area code has Mosinee smack in the middle...so that has narrowed it down a bit.
Could you send me all the emails you have built up with this Kevin Cybula.
Get everything you have on this guy documented...saved on disk, and printed out. Maybe you used be prepared to start faxing and emailing officials of his local authority.
Email me. I'd be willing to help you out bro.

Nathan returned my items...
Unfortunately they are now damaged.
Already informed paypal, and that this was obviously a scam that Debbie and/or Nathan tried to pull off but got scared after they were being contacted about it.

:Update:
Nathan contacts me at my izzzy12k@yahoo.com email addy.
Here a copy:
IZZY,
I am very confused as to what is going on. First of all, we thought we
were
getting something pulled over on us when we received a phone message
reguarding credit cards. This must have been the message you left.
After receiving the message, we called our local authorities to let
them
know about the message. This call is on record.
We then received a call from N.Y. and we called the number back. I
spoke to
a nice gentleman by the name of Peter Wago, who brought me up to speed
on
this matter. I expressed my concerns and told Mr. Wago that when; and
if,
the package arrived we would ship the package directly back to you.
We did not try to scam you. We both have good jobs, good credit, and
no
criminal records.
We sent your merchandise back to you in good faith not caring about the
shipping and handling charges, but just making sure your items were
returned
to you and trying to do everything we could on our end.
If there is anything else we can do please let us know.
Thank You
Nathan
Sure seems like he is trying to clear his name real quick!

When you shipped the items, did you insure it? Did he insure it when he shipped it? At times, if you have a new credit card, or have not used a credit card in a long time and all of the sudden, charges appear in large amounts--the CC comapny will freeze the accoutn until the cardholder contacts them. I had this happen to me when I stayed a hotel once. Boy was that embarrassing. Getting yer card declined in front of people.
I called and straightened it out with my card company. he needs to do the same and reimburse you for your troubles and damaged goods (if the items were not insured).

Here's a response I quickly got from Nathan:
Once again, I am sorry for the confusion.
I did not order these items and neither did Debbie.
I have no idea on the value of these items, but I did put insurance on
them
when they where shipped back to you.
Once again this matter is not a good deal for you or I, It has cost us
both
money. I am in the process of seeing if other items have been shipped
to our
address. Like I said earlier we think we are being scammed by someone,
I
hope this is not part of it.
I do want this resolved, but I will not pay for something I did not
order or
purchase.
As far as being contacted by anyone, we have not been. Except for the
two
original phone calls. The first call we have reported to local
authorities.
The second call we returned to the gentleman to find out what was going
on.
Nathan
I responded asking him if they never ordered and they are being scamed. Why did they accept the package, AND if they received the package due to someone else using their address and they do not know who "Kevin" is or could be?
Then how did "Kevin" know about the cracks created on the speakers during shipment which directly matches damage the speaker actually now have?
No response since...
BTW - the last emails with this guy, I've CC'd paypal, IFCC, and Squaretrade to help expose him and his lil bag of tricks. http://sysopt.earthweb.com/forum/biggrin.gif

In reference to Paypal....some people are taking Paypal funds only from people who use a bank account vs. credit card. Perhaps on your next sale you could add this requirement.
