Just found this article...HP invokes DMCA to quash Tru64 bug report (http://www.theregister.co.uk/content/55/26468.html)

The threat comes in a letter to SnoSoft from HP Veep Kent Ferson warning that the security researchers "could be fined up to $500,000 and imprisoned for up to five years" for its role in publishing code that demonstrated the vulnerability

Ive touched on this whole topic before, in another thread about 'Ethical Hacking'. So i guess this could be a good test case...

So has HP been sitting on the problem or has Phased acted irresponsibly

Of course though think... if HP wins, every MS windows platform ever released just became the most "secure" product on the market.

Its also interesting to think outside of this, cloning is legal in most aspects of what it entails, yet this is not. Go fig.
"We are like the guys that found out that Firestone tires have issues on Ford explorers," he said. "It's not our fault your Explorer has **** tires. We just pointed it out."
